Harley-Davidson Lemon Law in California: Don’t Let a Defective Bike Stall Your Freedom

In Southern California, a Harley-Davidson isn’t just a motorcycle; it’s a lifestyle. Whether you’re carving through the canyons of Angeles Crest, cruising the PCH toward Neptune’s Net, or navigating the tight lanes of the 405, you rely on that Milwaukee-born muscle to perform. You paid for the chrome, the rumble, and the reliability of a legendary American brand.

But what happens when your “Dream Bike” becomes a persistent nightmare? What happens when your 2022 Pan America won’t start in the middle of the Mojave, or your 2024 Street Glide has been at the dealership for “software updates” three times in two months?

If you are riding a 2021 or newer Harley-Davidson that has been plagued by recurring defects, you aren’t just “unlucky.” You may have a legal right to a full refund or a replacement under the California Lemon Law. At our firm, we specialize in helping Los Angeles and Southern California riders hold Harley-Davidson Motor Company accountable.

Does Your Harley Qualify? Cutting Through the Noise

We know there is a lot of misinformation out there. Many riders think the Lemon Law only applies to cars, or they think any “bad deal” at a dealership qualifies. To ensure we get the best results for our clients, we focus on high-quality claims that meet the strict legal standards of the Song-Beverly Consumer Warranty Act.

What We ARE Looking For:

Model Year 2021 or Newer

We focus on the modern era of Harley-Davidson technology, including the Revolution Max engines and the latest Milwaukee-Eight builds.

Purchased “New” or “Certified Pre-Owned” (CPO)

Your bike must have been purchased or leased with a manufacturer-backed warranty. CPO bikes from an authorized Harley dealer qualify!

Recurring Defects

You have taken the bike to an authorized dealer at least two to four times for the same significant issue, and they still haven’t fixed it.

The 30-Day Rule

Your motorcycle has spent a cumulative total of 30 or more days in the shop for warranty repairs (it doesn’t have to be 30 days all at once).

Safety Issues

If the defect involves brakes, steering, or sudden engine stalling, it may qualify with even fewer repair attempts.

What We ARE NOT Looking For:

Older Used Bikes

If you bought a 2012 Fat Boy “as-is” from a private seller or a small independent lot, the Lemon Law likely does not apply.

Dealer Scams

If a salesperson lied to you about your interest rate or snuck in an extra “service contract” fee, that is Auto Fraud, not Lemon Law. We focus on the defective machine, not the paperwork.

Customization Issues

If your bike is acting up because you installed an aftermarket turbo or modified the frame in a way that voided your warranty, that is a different legal hurdle.

Common Defects in 2021–2025 Harley-Davidson Models

Harley-Davidson has undergone a massive technological shift recently. From the liquid-cooled Pan America to the electric LiveWire (now its own brand but still under the HD umbrella), more technology often means more “ghosts in the machine.”

Pan America 1250: Electronic & Starting Issues

The Pan America was Harley’s bold entry into the adventure touring market, but the 2021–2023 models have been plagued by:

Software “Bricking”

The bike’s screen goes blank, and the ignition refuses to engage.

Adaptive Ride Height (ARH) Failures

The system that lowers the bike at stops fails, creating a significant safety risk for shorter riders.

Fuel Pump Failures

Sudden stalling at highway speeds, which is incredibly dangerous on LA’s fast-moving freeways.

Milwaukee-Eight (M8) Engine “Sumping” and “Transfer”

While Harley has made strides, some 2021+ touring models (Road Glide, Street Glide) still experience:

Sumping

Oil builds up in the crankcase, causing massive power loss and potential engine seizure.

Primary Oil Transfer

Oil “migrates” from the transmission to the primary, which can lead to transmission failure if not caught.

Infotainment and Boom!™ Box Glitches

On $30,000+ touring bikes, the GPS and communication systems aren’t just luxuries; they are part of the value.

GPS Freezing

The navigation system fails in areas with high interference or heat (common in the San Fernando Valley summers).

Bluetooth Disconnects

Persistent failure to link with headsets, often blamed on “user phone issues” by dealers despite repeated software flashes.

Sportster S & Nightster Electrical Gremlins

The new Revolution Max 1250T and 975 engines are engineering marvels, but the electrical integration has been rocky.

Phantom Error Codes

Dash lights for “Check Engine” or “ABS” that dealers “reset” but can never truly fix.

Battery Drain

Bikes that go dead after sitting for just two or three days.

Why the Song-Beverly Act is a Rider’s Best Friend

California has the strongest Lemon Law in the nation. It was designed specifically to prevent manufacturers from “stringing consumers along” with endless repairs.

The “Presumption” Period

In California, there is a legal presumption that your Harley is a lemon if, within the first 18 months or 18,000 miles, one of the following occurs:

1. The dealer has tried to fix a life-threatening safety issue 2 or more times.

2. The dealer has tried to fix a general defect 4 or more times.

3. The bike has been out of service for a total of 30 days.

Crucial Insight: Even if you are outside this 18-month/18k-mile window, you can still win a Lemon Law case! As long as the defects occurred while the bike was under the original manufacturer’s warranty, you have a claim.

Fee-Shifting: You Don’t Pay Us, Harley Does

This is the part that surprises most people. The California Lemon Law includes a “fee-shifting” provision. This means that if we win your case or reach a settlement, Harley-Davidson is required to pay your attorney’s fees.

No Out-of-Pocket Costs

We don’t charge you a retainer.

No Hourly Billing

You won’t get a bill in the mail for our time.

Success-Based

We only get paid when we get you paid.

Your Legal Remedies: The Buyback or The Swap

If your Harley qualifies as a lemon, you are legally entitled to one of two things:

1. The Lemon Law Buyback (Repurchase)

This is the most common outcome. Harley-Davidson Motor Company must:

  • Refund your down payment.
  • Refund all monthly payments made.
  • Pay off the remainder of your loan.
  • Refund your registration fees and taxes.
  • Reimburse “Incidental Damages”: This includes towing fees or rental vehicle costs while your bike was in the shop.
  • Note: The manufacturer can deduct a “mileage offset”—a small credit for the “good miles” you put on the bike before the first repair attempt.

2. The Replacement

You can choose to trade your lemon for a brand-new, substantially identical motorcycle. Harley handles the title transfer and ensures your new bike is free of the previous defects.

Navigating the “Dealer Stall” in Los Angeles

We see it every day at dealerships across Southern California, from Glendale to Marina Del Rey to Santa Clarita. You bring your bike in, the service advisor is friendly, but they give you one of these “Standard Excuses”:

“We couldn’t duplicate the problem.”
“That’s just a characteristic of the V-Twin engine.”
“The software update fixed it (again).”
“Harley-Davidson knows about it, but there’s no fix yet.”
Don’t accept these excuses. If the bike isn’t working as it should, it is the manufacturer’s responsibility to make it right. Every time you leave the dealership with a “No Repair Performed” receipt, you are building your Lemon Law case. Always make sure you get a copy of the Repair Order (RO) before you leave the dealership.

Frequently Asked Questions (FAQ)

You are in luck. California is one of the few states where the Lemon Law explicitly protects Certified Pre-Owned vehicles, provided they were sold with a manufacturer-backed warranty. If your CPO 2021 Road King is a disaster, call us.

Generally, yes—as long as the performance parts aren’t the cause of the specific defect. For example, if your infotainment screen keeps going black, Harley cannot blame your “Stage 1” air intake and exhaust.

Most cases against Harley-Davidson are resolved within 30 to 90 days. Once we present them with a “Demand Package” showing the repair history, they often prefer to settle rather than face us in court.

No. Harley-Davidson may try to steer you toward a private arbitration process. These are often biased toward the manufacturer. You have the right to skip arbitration and go straight to a legal claim with an attorney who has your best interests in mind.

Ready to Trade Your Lemon for a Check?

You didn’t buy a Harley to watch it leak oil or fail to start in your garage. You bought it for the open road. If your 2021, 2022, 2023, 2024, or 2025 Harley-Davidson has been in the shop multiple times for the same issue, it’s time to stop being “patient” with the dealership.

Our team will review your repair orders for free. If you have a case, we will fight to get your money back, and you won’t owe us a dime out of your own pocket.

Contact our Los Angeles Harley-Davidson Lemon Law experts today. Let’s get you off that lemon and back on a bike you can trust.

Does your service record show 30+ days in the shop? You could be eligible for a full buyback right now.
