Why the Song-Beverly Act is a Rider’s Best Friend
California has the strongest Lemon Law in the nation. It was designed specifically to prevent manufacturers from “stringing consumers along” with endless repairs.
The “Presumption” Period
In California, there is a legal presumption that your Harley is a lemon if, within the first 18 months or 18,000 miles, one of the following occurs:
1. The dealer has tried to fix a life-threatening safety issue 2 or more times.
2. The dealer has tried to fix a general defect 4 or more times.
3. The bike has been out of service for a total of 30 days.
Crucial Insight: Even if you are outside this 18-month/18k-mile window, you can still win a Lemon Law case! As long as the defects occurred while the bike was under the original manufacturer’s warranty, you have a claim.
Fee-Shifting: You Don’t Pay Us, Harley Does

2. The Replacement
You can choose to trade your lemon for a brand-new, substantially identical motorcycle. Harley handles the title transfer and ensures your new bike is free of the previous defects.
